Data Protection and Privacy
Information provided by you online or otherwise will be processed by Cowell's Garden Centre and used to provide you with the ordered products, for billing and accounts purposes, and to keep records of the transaction.

In addition, your information may also be used for the following: To keep you informed about Cowell's Garden Centre products, promotions and services.

In addition to allow us to check your creditworthiness and process your orders, the personal data you submit, and our records of your visits to the Site, will be used to monitor and improve our service to you, and for marketing purposes.

We may send you, brochures, leaflets and catalogues displaying our products and services, and may telephone you in order to tell you of promotional offers, to discuss account details or for market research.

We will respect the privacy of your personal data, and will comply with all relevant and current data protection legislation. Without your written consent we will not make our mailing list available for marketing purposes to anyone outside Cowell's Garden Centre, unless required to do so by a court of competent jurisdiction, we will not disclose your personal data to anyone.

Payment
After you submit an order to Cowell's Garden Centre, we will send you an acknowledgement of the same details in e-mail.

Please note that e-mails are acknowledgements, and are not acceptance of your order.
Acceptance of your order and the creation of a legally binding contract between us will only occur when we confirm your order and despatch your goods to you. Alternatively, we may decline all or part of your order for any reason, in which case we will advise should this be the case.

We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method or suggest that you visit one of our stores. Please note that products, prices and offers in our stores may differ from those featured on this site.

We accept all major credit and debit cards including Pay Pal. Payment is made at the Internet check out through Pay Pal, which can be accessed through our web site. Remember, you can still change your mind at the checkout as to whether you wish to continue with the purchase or simply delete your oder.

All Prices and charges on Cowell's Garden Centre web site are in UK pounds. They include any VAT payable, but exclude delivery charges.

We do our utmost to ensure that all information on this site is relevant, up-to-date and accurate. However, on occasion, an error can occur. Should we discover an error in the price or description of a product you have ordered, we will tell you and ask you whether you wish to continue with your order or cancel it.

When do I give my payment details?
Payment is made at the checkout stage, which can be accessed through our web site when you add an item to your 'Shopping Barrow'. You can still change your mind at this stage and amend your order as you wish. Payment is only made when you click to Complete your purchase.

When will I be charged?
The full purchase price will be charged to your card upon placement of your order.

Acceptance of Terms
By accessing the content of www.cowellsgc.co.uk and internet store within ("the Website") you agree to be bound by the terms and conditions set out and you accept our privacy policy. If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on the Web site and leave immediately.

Security and Privacy
Is it safe to shop online with Cowell's Garden Centre? Cowell's Garden Centre site uses Pay Pal and industry standard security methods to ensure that all the personal details you give us are not misused.

Is it safe to use my credit card over the internet?
The purchase area of our site is secure. We utilise industry standard SSL technology (Secure Sockets Layer) to guarantee a safe and secure shopping environment. All sensitive information such as credit card details, names and addresses are encrypted. This means that information passed between your computer and our web site cannot be read even in the event it is intercepted by someone else.

Delivery
Delivery must be to an address in the Mainland United Kingdom (excluding the Channel Islands, the Isle of Man, the Isle of Wight and the Scottish islands). All deliveries must be signed for (except items sent by post and which are small enough to be put through your letterbox). Please make sure you keep the receipt enclosed with your goods.

Most products are delivered either by courier, our own transport or by post, depending on their size, value and destination. Very occasionally different products in the same order may be delivered separately.

Delivery of very small items may be made by Royal Mail. (First / Second Class service) Royal Mail's vision is to be 'demonstrably the best and most trusted postal services company in the world'. Delivery of items are on a first class next day delivery service. Please note during busy periods this may be a two day delivery with notification of this delay.

Delivery of standard sized goods (Except 2 Man Lift Items) will be made by either Citylink or Fastway Couriers. (2 to 4 Day Service of Next Working Day). Both Citylink and Fastway Couriers offer a nationwide door-to-door sensitive express parcel delivery. Citylink or Fastway Couriers will handle and deliver all parcels as Next Working Day Delivery (ordered by 1pm), please note during busy periods this may be a two day delivery with notification of this delay.

Delivery of Large Trees (Including Christmas, Ornamental & Hedging Trees) are only available within our local area, unfortunately this is because of how fragile the trees are and their size.

Delivery charges are as follows;
Economy Delivery
£1.50 - £4.99 (Royal Mail) All small low weight products i.e gift vouchers, seeds -(First / Second Class next day recorded delivery).

Standard Delivery
£6.99 (Next day - 2 to 4 day Service) All Standard Items - Which do not exceed the weight of 25kg per item.
For orders to be delivered "Next Day" they must be processed before 1pm, any orders received after this will be delivered accordingly.

Legal Age for Alcohol / Knifes.
You must be at least 21 years of age to purchase alcohol. By placing your order on our website, on the phone, or in person at our store, you have represented to Cowell's Garden Centre that you are at least 21 years of age.

All Alcohol / Knifes delivered must be received by an adult of legal age. We will require a Photographic Identification if you look less than 25 years of age at the point of delivery.

Missing, Damaged or Incorrect Orders
We try very hard to ensure that you receive your order in pristine condition. If you do not receive all your products, please e-mail us at info@cowellsgc.co.uk or telephone (0191) 286 3403 (asking for the web-store Department). In the unlikely event that a product arrives damaged or faulty, please contact us at info@cowellsgc.co.uk or telephone (0191) 286 3403 (asking for the web-store Department).

Cancellations
If you have chosen to have your order delivered, you can cancel your purchase at any time either before or up to 7 days after delivery by:

  • Returning the product to our store (please bring your receipt with you and the card you paid with, so that it can be credited - in-store purchases only);
  • Emailing us at info@cowellsgc.co.uk;
  • Telephoning us on (0191) 286 3403 - please ask for the Webstore Department;
  • Writing to Webstore Department, Cowell's Garden Centre, Main Road, Woolsington, Newcastle upon Tyne, NE13 8BW.
  • Your product must be complete, unused and in 'as new, re-saleable' condition (e.g. if you have opened the box to examine the product you must have done so without damaging or marking the product in anyway). It should be returned with the original box, packaging and accessories.
    Any 'Free Gifts' received with the product must also be returned.

    You will receive a full refund, and the cancellation is free of charge provided you return the product to us under the above criteria, if you choose an alternative method of return, you must or may have to bear the costs of return.

    We cannot cancel your purchase when:

  • You return your product to us without proof of purchase;
  • The goods were a special order to your specification.
  • Return of Faulty Goods - Delivery Items
    If there is a fault with your product within 12 months of delivery (depending on the product concerned or other defect with your order), we will normally offer a prompt repair, exchange or refund.

    We will always offer you the choice of an exchange or refund if the fault occurs within 28 days of delivery.

    To qualify for a refund or exchange the product must be:- a) In otherwise in 'as-new, re-saleable' condition; b) Complete with any accessories and free gifts offered with it (and, if possible, the original box and packaging).

    Please return the product to Cowell's Garden Centre, Main Road, Woolsington, Newcastle upon Tyne, NE13 8BW or telephone Cowell's Garden Centre, on (0191) 286 3403 (9am to 5pm Monday to Saturday & 10am to 4.30pm on Sunday).

    If a fault occurs while you are abroad, please contact us after you return to the UK.

    This promise does not cover faults caused by accident, neglect, misuse or normal wear and tear. For consumable items (e.g. Food etc) we cannot accept returns.

    THIS RETURNS POLICY DOES NOT AFFECT YOUR LEGAL RIGHTS

    Modification
    Cowell's Garden Centre reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement.

    Cowell's Garden Centre have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

    Limitation of Liability
    Cowell's Garden Centre will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Website.

    Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of Cowell's Garden Centre it's employees or agents.

    Severance
    If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.

    Governing Law and Jurisdiction
    This Agreement will be governed by the laws of England and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.
